The Skechers broken hip lawsuit complaint alleges that the health risks of Skechers outweigh the absence of any benefit provided to the wearer, due to their pronounced “rocker bottom” sole. According to the lawsuit, the rocker bottom sole was intentionally designed to create instability and to change gait mechanics. While the Defendants promote Skechers Shape-Ups as footwear that will provide countless health benefits including improved cardiac function and orthopedic benefits, the lawsuit (3:12-cv-00614-TBR.) states that it is well established in the medical literature that changing one’s gait can and does cause chronic injuries, including fractures.
According to the complaint, the Plaintiff suffered a fall on October 5, 2011, while wearing a pair of Skechers Shape-Ups and walking on a flat surface. Suddenly and without warning, her Skechers Shape-Ups toning shoe pronated inward and caused her right ankle to collapse, causing her to fall. Upon admittance to the hospital, x-rays revealed a right hip fracture. The following day, the Plaintiff underwent a right bipolar hemiarthroplasty, and was hospitalized until October 14th. Upon her discharge, she required physical therapy and in-home nursing care. The Plaintiff claims that she has incurred significant medical expenses, could incur future medical expenses, and has suffered physical pain and mental anguish. The complaint further alleges she is now at increased risk for future health problems and disability.
