Monterey College of Law will hold the 2012 Heisler Moot Court on Friday, November 16, 2012, 7:30 p.m., at the World Theater, CSUMB. The event is free and open to the public. In the moot court format, four Monterey College of Law students present legal arguments on a fictional case to a distinguished panel of California Justices. This year's MCL student participants are Ramon Campos, Derric Oliver, Sonya Jifkins, and Kate Holland. The distinguished appellate panel includes Justice Terence L. Bruiniers of the California First District Court of Appeal in San Francisco; Justice Stephen Kane of the California Fifth District Court of Appeal in Fresno; and Retired Judge Richard M. Silver of the Monterey County Superior Court.
Celebrating its 26th year, the Heisler Moot Court raises a new legal issue – the government’s right to use cell phones as trackers and unmanned drones as eyes in the sky. According to Program Director Michael Stamp, “New concepts in privacy are upon us: privacy of location, privacy of public spaces, and the use of private and public information to predict where individuals are headed and when they will arrive. Does this surveillance make us safer? Is there an acceptable trade-off in privacy? This is what the Moot Court will consider.”
The Moot Court has been has been widely recognized as a unique and innovative learning experience for the students and for the larger community. The Monterey County Chapter of the American Civil Liberties Union and the family and friends of Francis and Friedy Heisler have provided inspiration, vision, and gracious support for the Heisler Moot Court for almost three decades.
The Heisler Moot Court is presented in honor of Francis Heisler (1895-1984) and Friedy Heisler (1900-1997) and their remarkable lifetimes of service to civil liberties, education, and advocacy in the fields of law, health, and the arts. ”Francis and Friedy were vital and active members of the Monterey Bay community and the larger world community. This Moot Court program is an ongoing living tribute to their values, their work, and their efforts to bring more justice and more peace to this earth. Monterey College of Law is proud to sponsor the Moot Court,” said Professor Joel Franklin, who served as co-director of the program from 1986 until 2011.
“The central premise of this community event is that the questions of public policy and civil liberties are too important to be entrusted only to lawyers in courtrooms,” said MCL Dean Mitchel Winick. “This Moot Court topic raises important questions about the boundaries between our security and liberty.”
The following are the four Monterey College of Law student presenters:
Ramon Campos received his B.A. in Economics from California State University Stanislaus in 2008. He currently works as a Paralegal at a Salinas law firm. He lives in Marina with his wife, Sophia, and his son, Cruz.
Derric Oliver, a San Diego native and Big Sur resident, received his Bachelor of Music from the University of the Pacific in 1994. He studied music business and entertainment management, and played the tuba. Derric pursued a professional musical career, touring as a singer, songwriter, multi-instrumentalist, bandleader, and business partner in a record label. He works for Heisler, Stewart & Daniels.
Sonya J. Jifkins received her B.A. in Politics, French and Francophone Studies from the University of California at Santa Cruz in 2008. Sonya was born and raised in Los Angeles County. She was a Fellow at The Panetta Institute for Public Policy and has worked both for the Los Angeles County and Monterey County District Attorney's Office. After law school, Sonya wishes to become a District Attorney.
Kate Holland currently resides in Hollister. She received her B.A. in Communications from California State University Monterey Bay in 2008. Before that, she lived, worked and went to school in New York City. She was a Fellow at The Panetta Institute for Public Policy and is employed as a law clerk at a law office in Monterey. She wishes to pursue a career in criminal law.
The following are the three Justices for the Heisler Moot Court:
Justice Terence L. Bruiniers has been an Associate Justice of the First District Court of Appeal in San Francisco since 2009. He was a Superior Court Judge in Contra Costa County for more than10 years. His legal career includes 18 years in private practice in commercial and business matters, and seven years as a deputy district attorney. He graduated from the University of California in Berkeley in 1969, and from Boalt Hall School of Law in 1973.
Justice Stephen Kane has been as Associate Justice with the Fifth District Court of Appeal in Fresno since 2006. He served 14 years on the Fresno Superior Court. Before being appointed to the Bench, he worked in a civil practice in Fresno, emphasizing litigation and trial work. He received his B.A. degree in economics from the University of Notre Dame in 1969. He graduated from Hastings College of the Law in 1976, where he was chair of the Moot Court Board from 1975 – 1976.
Judge Richard M. Silver served as a Monterey County Superior Court Judge from 1977 to 2002, when he retired. Since 2002, he has served as a Mediator and Arbitrator with JAMS in San Jose. Judge Silver was a partner with Francis Heisler in Mr. Heisler’s law practice in Carmel (1969 – 1977). He received his B.S. from the University of California, Berkeley in 1963, and his law degree from Boalt Hall School of Law in 1966.
